Freddie Aguilar, cradle snatching, PDAF, DAP & WMD

Leave it to the lazy plundering legislators of the Philippines making Ka Pervie errr Ka Freddie Aguilar as the unofficial ambassador to foreign pedophiles.

Lolo Freddie’s trending  publicity that’s going viral now will eventually serve as an invitation for foreign pedophiles to come on over to the pedophile haven without the risk of dealing with troublesome Taliban. While it is definitely worst in Taliban controlled areas where they marry off 8 year old girls to men as old as sexagenarian Ka Pervie the Philippines is really not that far off with 13 as the age of consent  for little girls.

Some wags are saying that Ka Freddie’s favorite key is “A Minor” and it does have some basis when he brags that it was not his first time to play house errr be in “love” with a minor since his 3rd wife was just 17 years old. Experience so to speak or was it serial pedophile openly admitting his attraction to little girls?

It seems that Ka Pervie consults his dictionary from time to time as his basis for justifying his cradle snatching saying the dictionary never or did not specify who should be in love. My suspicion is he did not just looked it up in the dictionary but the laws on statutory rape because it seems that our greedy legislators are so fixated with their PDAF and DAP that to this day we have a Taliban like laws when it comes to exploiting errr protecting our minor children.

Ex US President George Bush could have avoided waging war in Iraq looking for non-existent WMD when he could not have looked no further because it was in the Philippine congress all along, LOL. Say what, am I nuts or what, WMD in Philippine congress? Well, our present laws are antiquated and if ever they craft a new law they can’t seem to figure out if it makes sense and the reason is because of WMD (weapon of mass DISTRACTION) in the form of PDAF and DAP. They can’t focus because they are distracted and fixated with the millions in windfall profit errrr funds for their pockets ooops,  I meant constituents.

Can you believe that sexagenarian like Ka Freddie Aguilar can have sex with little girls age 12 to 18 without worrying about getting charged with statutory rape? If ever the victim files a complaint the little girl has to prove first that she is a virgin before she had sex with her boyfriend old enough to be her great grandfather. Now how exactly can that be proven when she already had sex with a cradle snatcher is indeed puzzling. Assuming it can be proven the offense is not considered a public crime and therefore the authorities will not pursue the case until the victim files a complaint. As if that is bad enough the complaint that can be filed was just for seduction which carries a light sentence and would probably be most likely a slap in the hand.

It is frustrating that we still lived in the dark ages when it comes to laws protecting our minor children. What is even more annoying is while they came up with HB 0681 that raise the age from 12 to 16 the age of consent it is still short of 2 years. Ironic that while they came up with laws addressing the problem of children in conflict with the law they failed to consider if the government has the infrastructure to implement the law properly to be effective. And while they saw the problem with minor children you would think that they would at least reviewed the flaws of the present law regarding the protection of minors from sexual predatory pedophiles.

As if the situation is not getting worse and at the time that the senate and congress is embroiled in PDAF plunder scandal Senator Ralph “Vilma Santos” Recto is asking for an increased in DAP, is he clueless or what or does he wander in his own reality?  This after his colleagues got caught not just stealing but plundering their PDAF, what was he thinking? When a scandal breaks out regarding thievery and plunder leaders with their moral compass still intact would have come up with safeguards to ensure and prevent their colleagues from raiding the coffers instead of asking for more. What message is Recto trying to send, they need more to speed up their insatiable appetite for dirty money? If you still think that Scrap the Pork is not the right call, think again because money and ton loads of it that can easily be plundered is a distraction thus they can’t do their job of crafting laws that makes sense.

Clearly, retaining PDAF and DAP serves as a WMD and of course makes pedophiles happy since they are too distracted to even come up with laws that makes sense. In the meantime enjoy the song of my idol and FB friend Dennis Garcia of Hotdog who Ka Pervie probably wants to hit with his old people's walker, LOL …………
I am not so sure if Maegan the daughter of idol Ka Freddie of Apo errr Anak fame understood what pedophilia means. She is raging mad and ranting at her dad's critics calling them morons and stupid. Opppps I guess that includes me, hehehe but then again she seems like detached from society because society to her is shackling, LOL.

Freddie Aguilar and her daughter Maegan says it is love, but the what the father and daughter probably failed to do is look up the meaning of pedophilia which is defined as the act or fantasy on the part of an adult of engaging in sexual activity with a child or children. If they look it up some more like in a Britannica encyclopedia it is even considered a mental illness, perhaps they need to add more vocabulary instead of just looking at the meaning of love so they don't get in trouble with society and the online world in particular because our laws are useless.

Kahit nasaan ka man ngayon, kung nasa isang yate sa Celebes Sea palabas ng Pinas o nagpaparetoke ng mukha at katawan sa Bangkok o nagpapatanim ng balbas at bigote sa Tayuman, susulat pa rin ako. Dahil isa ito sa kaya kong gawin habang ngumangata ng sinangag at Reno Liver Spread.

Sex Predators, Pimps, & Prostitution Ring in the Middle East at Philippine Embassies

Overseas Filipino Workers mostly domestic helpers are easy prey for employers that are sexual predators thus they escape. If they are not caught by the police forcibly retuning them against their will to their employer where they are more likely than ever to be raped, they become runaways. Quite a number end up as runaways and desperate seeking the help of our embassies to repatriate them back home.

Distressed OFWs are those we watched on television and read about in newspapers living in squalid tents, full of hope and dreams for a better life only to end up victimized in untenable working conditions, their contracts violated and becoming prey to all sorts of exploitations. Perhaps it’s the culture that’s foreign to them as some desperately tries to rationalize but rape and outright cruel treatment to fraudulent contract violations is not exactly cultural but criminal. It is bad enough that Filipinos become prey to these greedy inhumane exploitative employers and outright criminal sex predators but to be victimized further by our own people cloaked in authority is the vilest and despicable that one can heap on their very own people.
Cleansing the Source of Philippine Political Wisdom
When Walden Bello an Akbayan party list representative broke the news on sex predators at Philippine embassies regarding some officials having sex with distressed OFWs, pimping, and operating a prostitution ring in return for plane fare tickets for repatriation, the reaction we expect should be that of being scandalized and anger. Unfortunately, instead of being incensed enough to act some are just too numb and dense as if these are normal daily occurrence and that Walden Bello was just grandstanding at the expense of the people he is accusing. Worse one of the accused Mario Antonio, welfare officer of the Philippine Overseas Labor Office (POLO) in Jordan in denying his wrong doing, brazenly accused human traffickers and manpower recruitment agencies as those behind the “smear” against his “reputation.” In so declaring, he of course implied if not literally saying that Walden Bello is being used by the human traffickers and recruitment agencies. In effect Antonio is saying that Bello was hoodwinked or is one of them only show the pervasive culture of corruption and criminality afflicting government officials.

Of course that brazen counter accusation against Walden upsets him and probably most people will get upset too. It is understandable and as expected when he threatened Mario Antonio with a libel suit if he continues to blabber nonsense. Mr. Bello is within his rights to file a criminal libel suit against Mario Antonio but it will be better to just ensure that they have all the evidence to pin down all the culprits, enough to land them in prison. He can then file a libel suit after their conviction to add to their sentences and maybe enough to lock them up for good so they can throw away the key.

Anyway, what kind of people takes advantage of an already distressed fellow Filipino becoming so desperate that leaves them with a very limited option to refuse the sexual advances of these embassy sexual predators? They went there to seek greener pastures and they end up victimized further as subject of human trafficking ending in a prostitution ring courtesy of the embassy prostitution ring operator and pimp when they are tasked to assist and help them. OFWs dutifully contributed to OWWA funds so that if they find themselves in a desperate situation that very contribution will at least be their insurance that they can fly back home. Since these plane tickets are covered and paid for by OWWA , these predators are defrauding not just OWWA but the OFW contributors as well while denying distressed OFWs the benefit that rightfully belongs to them. Worst they are scammed and forced to pay through sexual favors or prostituting themselves robbing them of whatever dignity is left of them when they should not be paying in the first place? Now let me ask this question if I may, did the Philippines set up a Mafia prostitution and racketeering front in the Middle East courtesy of the Philippine Embassies?

Unfortunately government people seem to operate and think like they are or in creating their own reality that we normal mortals do not see or understand such as this statement attributed to DFA Secretary Albert Del Rosario as “disconcerting” but still “hearsay.” Although he changed his tone when he spoke to Mr. Bello that defensive attitude only encourages criminals in their outfit to be more brazen. Recalling the named individuals accused of sexual molestations to actually exploiting the weaknesses of the distressed OFWs by having sex ,pimping, and operating a prostitution ring to explain themselves is moving in the right direction. Calling all the Ambassadors in the region to shed light and come up with policies to avoid a repetition of the scandal is also a move in the right direction. Yes, forming a fact-finding body is indeed what they need and it should be applauded. While at it I hope they also realized that the reason we have distressed OFWs ending up victimized further by the sexual maniacs, pimp, and prostitution ring operator predators cloaked in diplomatic immunity is because the pleas of the desperate OFWs fell on deaf ears? Criminal predators are very keen on seizing the opportunity and are only encouraged further when pleas and complaints by OFWs are not attended to making them more desperate enough to fall victim to their exploitation and probably even thanking them just to get out of the hellish situation they are in.

While those moves are in the right direction, they are not enough because we are talking not just about policy breach here but a criminal act. A criminal act of fraud, estafa, sexual molestation or having sex with desperate , pimped and trafficked to prostitution scammed into believing they have no other option but to submit to the pervert's demand using their position and the embassy for their nefarious sick criminal activities. Is it too much to ask that the DoJ should get involved here instead of the jokers at the senate and for them to instruct the NBI to conduct a criminal investigation by gathering evidence since that is their expertise and not some wannabe jokers trying to impress the gullible public? Is it also too much to ask that said "parallel investigation" be conducted by the palace for them to just ensure that investigations by criminal investigators are conducted professionally in a fair and balanced manner in accordance with what is allowed by the law to ensure that if the accused are indeed guilty of the crime, they are not able to escape justice via technicalities?

The “swift action” by the DFA in forming a fact-finding body is serious business but a little too late because had they listened to earlier pleas of the OFWs this kind of problem would not have escalated into a huge international embarrassing scandal. That is if indeed they are really serious and not just doing the usual damage control since most in government still believe that people are so gullible. The OFWs deserve better, their contribution consistently kept the Philippine economy afloat and is this really how some in the government repay them for their sacrifice to their family and the nation? Oh, and if you are wondering why the US has not removed the Philippines from tier 2 for human trafficking, look no further but to the Philippine embassy people using our embassies as front for prostitution ring exploiting distressed OFWs.

Imee Marcos, Manny Villar, & JV Ejercito’s Offshore Secret Bank Accounts

Where is the outrage?

Imee Marcos and her sons was the first to be exposed by PCIJ owning secret offshore bank accounts followed by Manny Villar and JV Ejercito. These are just the initial installment of people with secret offshore bank accounts, expect more names to follow considering that what the International Consortium of Investigative Journalist (ICIJ) has uncovered dwarfed the WikiLeaks in comparison. Lest some pathetic narcissist politicians fool you people into believing this is a local demolition job to spoil their chance of winning a pillaging privilege seat in public office, take note that this is an international investigation. 
While it is shocking to discover that there are Filipino politicians even the disgraced ones whose dictator father has been deposed for the pillage and plunder of the Philippines, this is really not just about them but an investigation into the workings and how the offshore banking system can be taken advantage by all sort of international criminals. Lest some local politicians fool themselves and the people that the world revolves around them this is a cache of 1.5 million files of 120,000 offshore companies measured in gigabytes that is 160 times the size of WikiLeaks. A treasure trove of information needing 86 journalists from 46 countries to sift through the documents that goes back to 30 years of transactions.

It’s a veritable who’s who of the international rich and famous and of course the infamous like con men, corrupt politicians, tax evaders, money launderers and international criminals but what is downright pathetic if not excruciatingly comedic is the reaction of some named characters and their shallow partisan in the Philippines. Typical response was that of JV Ejercito questioning the “timing” of the revelation which he claims was a “demolition job” for his being a top contender in the senatong errr senate election. Excuse me but is he saying the 86 journalists from 46 countries should wait for the results of the Philippine election before they divulge their findings? Pardon me while I barf at the shameless narcissism but does he really think he is that important to the international community of journalist?

Where is the outrage? Is it because people are busy trying to make a living or scrambling for the crumbs thrown by the candidates in the patronage and personality popularity contest we mistook for electoral exercise? Anyway, a look at the date of the opening of the offshore secret bank account of JV Ejercito shows it was in 1999. JV is a private citizen at the time the account was set-up who became the mayor of San Juan in 2001, where did he get the money to set up a dollar account and a secret offshore bank account at that? One thing we know is his ex-convict father Erap given presidential executive pardon by a potential soon to be convict Gloria Arroyo was the president when he opened the offshore account. Some wagging tongues are asking if said secret offshore bank account has anything to do with his public quarrel with his half-brother Jinggoy, but I dare not go there.

The revelation on Imee Marcos secret offshore bank account only means that it is a mistake or plain stupidity for the people to have allowed such travesty of letting the deposed dictator back to the country and worse allowing them to once again rule their fiefdom. While the like of these politicians like Imee Marcos continue to “praise” the OFW’s contribution to the Philippines with their billions of dollars in remittance to the country they shamelessly and hideously send them back out as fast as the OFWs can send them into the country. Now where is the outrage?

Unfortunately, no one really goes to jail for failure to disclose their assets in their SALN because our authorities are too dumb or was it too beholden to even consider following up on investigating if those assets are legitimate or not which is more likely illegitimate. After all why hide it in public if it was legitimate? Guess who are the first to complain about the endemic culture of corruption? Let us see if this administration is really up to the challenge but then again I doubt it that they are really serious in their straight narrow path to righteousness when they failed to prosecute the former Thief Justice errr CJ Corona, so can we expect anything different? I hate to think that we are just a big joke and truly a basket case in Asia, can we for once show our outrage and demand that those implicated be prosecuted without let-up until they pay for their crimes?

Media Presstitution in the Philippines the Enablers of Political Dynasty

The non-debate on Political Dynasty Part 2 & 3, conclusion of part 1.

Now why do society view such perversion to be normal can be traced to what could have been a noble intention gone awry that started the very first day the dictator was chased out of Malacanang Palace. What is ironic is that shallowness seems to dictate the sentiment of the perennial complainers looking at the surface readily blames what they thought brought us to where we are. Can we blame them when the media can’t help themselves in presstituting their profession adding to the confusion and dumbing down of the people?

Let’s face it, when the dictators was deposed there are people who immediately went on mimicking the very people the EDSA “revolutionist” loathe and right away established their stranglehold in their own turf. One would think that replacing a 2 party political system with a multi-party political system would have leveled the political playing field, providing access equitably among the citizens especially with the inclusion of the party list and prohibition of political dynasty.

The constitutional provision on the prohibition of political dynasty requires the lawmakers to define political dynasty and to what degree of consanguinity and affinity is covered by legislating and passing an enabling law to that effect. No ifs no buts about it and it is as simple as it can get and yet some media practitioners in presstituting their profession would rather misinform and play dumb as if it was the most mysterious and complicated subject they have encountered all their life. Instead of informing the public on the failure of the lawmakers to pass an enabling law for the past 25 years they are acting as the enablers of the trapos in rationalizing the proliferation of political dynasty. In effect when the media goes on presstituting their profession they drug errr drag along the gullible public into enabling politicians to transform the multi-party political system into a family political dynasty system thus the absence of any sensible ideology or platform of governance.

In part 2 of the PTV4 political dynasty forum Enrile states it is difficult to understand and the framers of the constitution did not know what they want thus they left it to the lawmakers to define what they can’t comprehend, LOL. The difficulty is not how political dynasty is to be defined but the opposition coming from people with vested interest already raring to set up their own political dynasty in their respective turf on having the prohibition included in the constitution.

Dynasty he states originated with the monarchy but our dynasty is different because the people are the one's appointing them and not by a single person or the king. True dynasties are built thru the electoral system but under a system where whoever has the guns, goons, and gold in a personality and patronage based electoral contest determines who has the upper hand and the likely winner. If it was indeed the people or the boss as Pres. Noynoy Aquino says that determines the outcome of the electoral contest can someone please explain why the likes of parricidal maniac convict Ruben Ecleo, pedophile convict Romeo Jalosjos, and the mass murderer Ampatuan clan are unbeatable in the electoral process?

Funny how Enrile complains about the absence of a clear cut definition what constitute political dynasty and will support it if there is one. As if to up the ante even says he is willing to retire or resign if there is a law and even blames the framers of the constitution for leaving it to the lawmakers to define the law. Perhaps that’s a typical reaction from people who knew exactly what was needed but refuses to take action because the longer they violate the constitution the longer it becomes acceptable and give a false sense of hopelessness that it can never be done.

The state of our pathetic political system where political dynasty proliferates and getting stronger when it is prohibited by the constitution was best described even though as a joke by JC de los Reyes an Ang Kapatiran Party (AKP) senatorial candidate:
“Political dynasty is government privatization at its best.”
While Lito Yap David also of AKP brought up the people’s initiative on their proposed bill defining political dynasty 6 months ago with the Comelec and wrote them recently has not been acted upon. He further states that our feudal system stunts our progress that serves as a breeding ground for political dynasty.

Former VP Teofisto Guingona warns that there is a potential for seventy (70) families to control the Philippines which is the very reason why the state guarantees equal access to public service. Of course any student of politics in the Philippines will tell you that members of the ruling elites of the political dynasty will not give it up without a fight.

Conrado de Quiroz will of course insist on his flawed logic that there is no need for a law ignoring the constitutional provision and assert further that culture tramps laws, LOL. He must have been referring to the trapos with Mafiosi culture that is so prevalent with the criminal minded and culpable violators of the constitution. Just because they are culpable violators of the constitution repeatedly for the past 25 years does not make it right or legal, calling a criminal by any other name is still a criminal, LOL.

Eden Co one of the panelists while acknowledging the fact that the prohibition of political dynasty was the result of the anti-oligarchy and dictatorship sentiments at that time. It was surprising for her though that the constitution is very “vocal” on political dynasty prohibition and other nations never banned them. She must have been hinting at the rights and freedom of citizens to run for public office while ignoring the very reason why political dynasty is prohibited, for the state to guarantee equal access to public service.

As if this forum was not boring enough part 3 truly dumb down anyone who watched it, LOL.

Bam Aquino the brilliant wannabe clone to the late Benigno Aquino laments the cost of getting elected and urge as if daring people to define political dynasty now. Either he lacks manurity errr maturity acting like a child, or blinded by his desire to be a senator that he becomes so ignorant not knowing that the people can’t define or pass the law. The only time the people can do this is through the people’s initiative route of getting 3% of the voter’s signature in a petition for a referendum with a proposed bill defining political dynasty.

Atty. Jennifer Atienza brought out the problem of no one really follows the campaign financing limit. There's a lot of confusion because it was not defined she further states. Hmmmmn, seems like there is a pattern here of violating whatever laws there is when it comes to laws that makes it difficult for political dynasties to get elected is it not?

Conrado de Quiroz is so out of it even agreeing with Bam Aquino on the uneven political playing field by enacting laws making turncoats illegal. Duh, if lawmakers can't come up with a simple enabling law defining political dynasty for the past 25 years what makes him think it will be easy to enact his pet law? LOL

Edna Co states the obvious on the power of the media, by having more substance and direction. Well, this forum is a classic example of lacking in direction and purpose since they start with a wrong premise asking whether there is a need for a law when it was enshrined in the constitution.

Bam says he believes that the Filipino people are intelligent enough to choose the right candidates and that some candidates see their candidacy as an avocation. Really, why are you running if that is the case? One who sees it as an avocation will of course examine where he is at in that equation especially in the context of prohibited political dynasty.

If there is anything that was useful in this forum it is non-other than learning that AKP has started the people’s initiative through a signed petition to have a referendum on a proposed bill defining political dynasty. We can always use the election to mobilize and organize the people in gathering pledges to vote only candidates who will commit to passing enabling laws. While we know that the likely chance of success is nil it will be the start of consensus building in preparation for the signature gathering for a referendum on a people’s initiative for a referendum on the a proposed enabling law defining political dynasty. Now if only the medial will have some "direction," no actually we just need them to stop the presstitution and call it what it is instead of telling us that the prohibition of political dynasty is complicated when it was not.

Esperlita Garcia a.k.a. Cyber Perling, State Enemy of PNoy’sTRO’ed CyberCrime

In the Philippines it does not matter what the law says, what matters is how it is interpreted by onion skinned public officials even in far flung municipality of Gonzaga in Cagayan. Gonzaga Mayor Carlito Pentecostes Jr., felt he was libeled or his reputation tarnished when a retired teacher and grandmother who happens to be a staunch environmentalist in Gonzaga posted an update on her FB page. I am quoting the so-called “libelous” portion:
My fb friends are asking me what happened in the rally at the Saint Anthony’s Academy of Gonzaga (SAAG) yesterday morning, so here. I wish to inform everyone that the peaceful trooping of Gonzaganians at the starting point venue of the rally was harshly dispersed by the Mayor of Gonzaga who was with more or less 10 armed and uniformed military men and with a firetruck and several vehicles near the SAAG gate along the national highway. Gonzaganians wanting to join the peaceful rally were hindered by the Mayor’s group. What is so shocking to know was the bullying words of the mayor to one of the invited speakers of the KALIKASAN PNE when speaking to the mayor, “Mayor Sir, it’s the constitutional rights of your constituents to conduct a peaceful rally to air their protest against mining within the communities.” “NPA ka ‘no? Walang constitution sa akin. Ako and Mayor ditto. Lumayas kayo, “ the mayor angrily answered as he grabbed the video camera being in the hands of one of the protesters and angrily threw it with force to the ground.
Well, that is really terrible, no I did not mean what Garcia wrote but is it libelous? If there is anyone who needs to get a lesson it is none other but the mayor. First of all you don't bring military men in a peaceful protest because military people are trained to kill people unlike the police who are trained in crowd control. Second of all the mayor ought to get a lesson on tolerance and the military should have restrained the mayor if they are indeed the protector of the people.

If that is libel does that mean that if Gonzaga Mayor Carlito Pentecostes Jr., slaps me silly that I will be sued for libel if I posted my experience on Facebook? It seems the local DoJ led by Assistant Provincial Prosecutor Edward Javier sees the crime of e-libel even if the SC issued a TRO better than the highhanded treatment of the protesters by the mayor that they went ahead filing defamation of character and libel against a retired teacher and Grandmother Esperlita Garcia. Ever wonder why real heinous crimes and crimes committed by well-connected powerful persons remain unsolved because they seem so fixated at trying to secure a conviction against a grandma? So they say they are allowed to make mistakes but filing a complaint of libel citing RPC Article 258 on abortion is not exactly an oversight when they meant RPC article 353 and 355 which is not a typo but more of being confused, LOL. Seems funny when abortion came into the picture but in their haste to score a  3 minute of sound bytes  of fame their incompetence got exposed instead while dragging RTC Judge Tabaco in their folly on the strength of RPC Article 258 when they meant to file libel, that states: 
Abortion practiced by the woman herself of by her parents. — The penalty of prision correccional in its medium and maximum periods shall be imposed upon a woman who shall practice abortion upon herself or shall consent that any other person should do so. 

Any woman who shall commit this offense to conceal her dishonor, shall suffer the penalty of prision correccional in its minimum and medium periods.chanrobles virtual law library

If this crime be committed by the parents of the pregnant woman or either of them, and they act with the consent of said woman for the purpose of concealing her dishonor, the offenders shall suffer the penalty of prision correccional in its medium and maximum periods.

Well, blow me down and slap me silly but this is a legitimate WTF moment!  Now whoever penned this revised penal code I hope is not one Talibani honor killer, for one the language seems vent on penalizing the woman and her mother for concealing the “dishonor.” Now, why the fixation on dishonor when all the while it was supposed to be to preserve life? Okay, let’s give this a rest since this should be another idiotic topic we can discuss next time around, LOL.

Now, what’s up with the judge? Did Regional Trial Court (RTC) Judge Conrado Tabaco had one too many tobacco or something  that he did not even read the complaint and failed to catch the “error” of using RPC Article 258 on abortion for a defamation and libel complaint filed by the geniuses at the local DoJ led by Assistant Provincial Prosecutor Edward Javier? why issue a warrant of arrest  for violating abortion RPC, did he even check that grandma Perling is 62 years old and unlikely to get pregnant much less have an abortion? Eh magkano ba este what was the warrant of arrest for when obviously someone did not read the complaint or was that just what Perling feared that it was meant  as a pure harassment?  If the judge used his due diligence he would have rejected the complaint right there and then but to go further and issue a warrant of arrest is not exactly just a case of incompetence but null and void and therefore Esperlita Garcia’s arrest is illegal?

I can understand that they are in the boondocks but the municipality is online so how did they not know that there was a TRO on RA10175 and no matter how they lie este explain that they filed the complaint based on RPC Article 353 and 355 and not RA10175 the 2 cited articles 353 and 355 does not cover Facebook or the internet. Did they not even ask Vicky Belo or are they fixated with Hayden Camera este Argee Guevarra or they are too engrossed on giving retired teacher Esperlita Garcia a hard time? The DoJ in Manila refused to file a case in 2009 and what makes it different now if I may ask, because it involves mining compared to just small time bust butt jobs?

Another legit WTF moment is when NBI director for Cagayan Valley Hector Eduard Gealogo says they did not conspire with Mayor Pentecostes or manhandled Garcia during the arrest. Maybe true but they did not read her, her Miranda rights and just hauled her to jail. Arresting Garcia on the crime of abortion when the complaint was meant for defamation of character and libel is therefore illegal, meaning her arrest and her imprisonment is also illegal. Now what’s the swift action all about, does she even posed a danger to people and it took 3 agents to arrest her? Don’t the NBI had more pressing things to do like hunt down the suspect in the Ortega murder case, or how about arresting Ecleo the parricidal murderous killer who has already been convicted and yet remains at large? Ok, I guess they need to bring down pesky retired teachers so the mayor can teach her a lesson, what exactly was the lesson again if I may ask? Now if the statement of Esperlita Garcia is “libelous” what about this statement from Pentecostes, are they not libelous and I quote:
“Wala akong sama ng loob sa’yo, dahil kung may sama ako ng loob sa’yo, hindi na kita iisyuhan ng mayor’s permit sa negosyo mo kahit hindi siya nagbabayad ng tax. So walang harassment, kundi ginagawa ko lang ang karapatan ko dahil sinira nila ang puri ko kaya nag-file ako ng libel case,” he added.

Environmentalist?

Pentecostes also questioned Garcia’s stand against mining, alleging that several private properties of Garcia and her family in the province have been open to mining operations.
“Ang totoo, may mining operation dito sa bayan namin pero hinihigpitan namin ang monitoring dito. Ang hindi ko lang maintindihan, sinasabi niya na siya ay environmentalist. Siya mismo ang nagpapamina sa tabi ng bahay niya at sa tabi ng mga bahay ng mga kapatid at magulang niya. Hindi ko maintindihan,” he said.

“Sinasabi niya na anti-mining siya, eh bakit niya pinayagang ipamina ang mga private property nila?” he added.

I would have believed what Pentecostes was saying but I asked Esperlita Garcia on the above claims and this is her response:
He is lying for i never allowed mining in my own property. He said he was not aware of my arrest. It was just then the own initiative of his lawyer who requested the services of the NBI to serve the warrant of arrest against me. He even said, he was considerate to me that inspite of my failure to pay my taxes, he just issued me Mayor's Permit. Is the LGU his own that he can just allow business to run without paying the needed business tax? I was charged a criminal case for a VIOLATION OF MUNICIPAL TAX ORDINANCE even if I had paid all my financial obligations at the LGU he leads. Is this fair? this is the reason, I need to attend a court hearing on this criminal case against me tomorrow, Oct 25. He makes me miserable for my anti-mining advocacy hence these two baseless cases against me filed by the Mayor himself.
This is turning out to be a circus and CJ Sereno should step in and ask RTC Judge Conrado Tabaco to explain why he should not be sacked for issuing a warrant of arrest on a libel case citing RPC Article 258 on abortion. Cite the local DoJ for ignorance of the law when e-libel does not technically exist based on the TRO they issued and why did they involved the NBI when clearly Esperlita Garcia could not hurt a fly and pose a danger to no one. The DoJ is a department that is under the president and they should not utter things that's so childish and unprofessional when Asst. Prosecutor Edward Javier pouts and sulks on Garcia airing her side to the media. Well, anyone who was wrongfully accused on a law that technically does not exist, wrongfully charged, arrested and imprisoned illegally with abortion when they meant libel and on top of that posting a bail is like being victimized by a kidnap for ransom gang. A complaint against the NBI for illegal arrest and imprisonment should be in order if we want this incident as what the mayor says to be a teachable moment and not just him giving a “lesson” to a grandma. The DILG must school if they are not doing it already local elected officials about tolerance and proper use and management of of the military, police and the National Bureau of Investigation.

What the mayor, the local DoJ people, and the NBI did was showcase the feudal mindset of people given authority and sadly they seem incapable of handling it correctly. This is like the problem in the legislation of Cybercrime Prevention Act of 2012 or RA10175 we have people who are clueless on the workings of the internet specifically Facebook regulating what is beyond them. When people post on Facebook, it does not automatically show everywhere or worldwide as some ignoramuses would like to believe. It took me awhile to look for the posting in question and all I got was a jpg image instead of the original posting so please stop hallucinating that it was that easy besides who cares about the reputation of a small municipal town mayor? It is not like politicians in the Philippines are highly regarded for integrity, so quit it and stop harassing grandma you bullies!

The Pride of Ciara Sotto, Sonny Angara & RA10175 in connection with The Code of Omerta

One of Benigno Aquino III’s campaign promise was the passage of the Freedom of Information (FOI) or something similar to that effect but as soon as he won it seems that it fell down the cracks errr on the bottom low of the president’s priority just like Jueteng . But then again does he have his priorities in order or what?

When he was pressed to honor his commitment on FOI Aquino says WE (yes WE instead of them) are not ready yet for FOI and things need to be in place for that to happen. The problem was instead of giving us FOI in the interest of transparency which this president proudly dangle to highlight what separates him from the run of the mill trapos he gave us instead RA10175 or the Cybercrime Prevention Act of 2012.

Perhaps one can argue that it was Tito Sotto who inserted the e-libel provision (which remains criminalized that has been gathering dust for the longest time in the house of congress supposedly in line for amendment for downgrade down to a civil offense instead of criminal offense) but he could have vetoed it and urge the legislative branch to remove the unconstitutional provision on libel that is a degree higher in criminal imprisonment penalty.

Why the 180 degree turnaround, was it because they need to pass RA10175 first to "control" or "manage" the flow of "sensitive" information that WE the people are not prepared to take? Are our politicians bound by the code of Omerta that it appears that they are willing to look like a dumb fool in cyberspace at that is nut errr not even funny anymore?

Now whoever is giving our senators especially Angara lessons on the complexities of the internet, reach, and the social media are doing our steamed errr esteemed senator and the people he represents a disservice. It was excruciatingly painful to read his views and rationale on the passage of the Cybercrime Prevention Act of 2012 especially the Sottomized the E-Libel provision that makes him look like a trying hard relic of the past desperately disguising as digital savvy nerd, LOL.

I am sorry but if one click is all it takes to send your message libelous or not to the world is a fantasy that is not even worthy of being written as a fiction novel. Let me share what I wrote in the comments section of the “one click” article:

Ignorance indeed is bliss, hehehe. One click sends it to your page in social media but not necessarily the world because of the following:

1. Your reach is limited to your circle and number of connections (friends, contacts, etc) and the setting of your page should be public all the way.

2. The right terminology is not one click sends your post to the world but one click makes it accessible to the world if you set it right as in public all the way, hehehe.

3. You have to be Bill Gates or Zuckerman for the Angara phrase of one click to apply since their followers are worldwide and by the millions.

4. One click does not send it to the world for any Pedro or Maria or even an Angara, LOL.

When you find yourself in the hole the rule is to snap out of it so you can simply step out of it rather than digging deeper till you are stuck, LOL. Criminalized libel is antiquated and unacceptable in civilized societies so please stop embarrassing your countrymen. 10% of whom are outside the Philippines that serves as a reminder to other nations how backward is the Philippines and with one click sends to the world their ignorance of penalizing civil "offenders" a degree higher on criminality rather than civil penalties of fines and sanctions.

If one click is all it takes to send your message across worldwide I am sure SEO gurus would like to know and learn the secrets of the trade from our steamed errr esteemed senator Angara. I hope Senator Edgardo Angara is aware that it is the elusive one click that the monetized bloggers are searching desperately like the legendary Juan Ponce de Leon’s quest for the fountain of youth.

The problem it appears may come from the culture of kissing peoples’ behind that overbearing staffs and researchers of the you get what you paid for kind are feeding these legislators with bad information. Just like a computer our legislators will also succumb to the garbage in garbage out principle.

When we are the one who will suffer the consequence of their follies Mr. Angara if he really cares understood the repercussions should not persuade us to give the law a chance. Say what now? Give the law a chance as in wait for the overcrowded jails to fill to the brim and further worsen the court backlogs with petty e-libel complaints just so you people can see the folly of your unconstitutional RA10175? I wonder if this is what makes Senator Angara’s son and namesake Sonny Angara proudly states was what makes them stand out among political dynasties because of their proud legacy. Well that does not surprise people anymore since Senator Angara goes a long way back to the days of the frozen stiff one whose legacy haunts us like a recurring nightmare to this day.

And then there is Ciara Sotto who no matter how her dad shamelessly plagiarizes mere bloggers or what most people says about her dad Senator Tito Sotto, she still sees him as a highly “principled” man. Yeah right, if Sotto is a highly principled guy I am the Prince of Wales and that lucky guy with Lady Kate in England is just an impostor, LOL. Of course any daughter will see things subjectively because of the emotional attachment but it has its limits when it becomes so obvious or the child was molded in a numbing environment that affects their mores or what is right and wrong. Ciara Sotto calls her dad’s detractors haters and she herself has earned some followers that are not exactly fans but those waiting for her meltdown as she seems to be headed in that direction with her arrogance, to quote:

Herself having become the target of criticisms for coming to the defense of her father, Ciara said she is now used to coming across "haters" on the Internet.

"Nasanay narin naman ako na ganyan, kasi (I got used to it because) you really can't please anybody and I accept that," she said.

"I won't stop just to please them. And I wont stop naman para mainis sila (so I can annoy them). I'll just say what I feel, and I know naman the truth, and it doesn't really bother me anymore," she added.

Fantastic, I wonder how she would feel if she realized she was wrong all along. Unfortunately she is high on that Trapo pedestal that it will take a miracle of biblical proportion for her to see what is morally right and just. One who never knew what is fair and just will of course not appreciate how it feels to be robbed and of intellectual property at that is probably something they will never grasp.

Bullies and Bullying in the Land of Patronage

The saga of Allan Canete Bantilles aka Roy Negro unravels and it is not a very pretty sight to behold.


What does Allan Canete Bantilles aka Roy Negro and Robert “Blair” Carabuena have in common? They both appear to burst with their violent temper when confronted with situations where civility and dialogue are a must in resolving the problem before them. They both are gun owners with a revoked license up for confiscation and Robert “Blair” Carabuena must be pissed at Allan Canete Bantilles aka Roy Negro for getting him back into the limelight of public and authorities attention.

In a nation where patronage plays an important role in a personality based political system where corruption thrives and becomes endemic it is natural for mindless people in power to equate might is right. After all being in a position of power means one can dictate or shove whatever it is they want without much resistance when one has tremendous influence as a result of extended political connection. Extended political influence brought about by their enterprising spirit of turning politics into a family business with some becoming so successful turning their mom and pop political shop into a very successful entrepreneurial empire.

It appears that Allan Bantilles has good connections or friends with the right influential people, the Peping and Tingting Cojuangco couple thus the lame response of Collegio San Agustin Rector Fr. Horacio R. Roriguez, OSA. In fairness to the Cojoangco, while Tingting is reportedly a member of the board of Collegio San Agustin there are no reports if she tried to meddle with the incident or exert her influence. But then again, the question was if the CSA administration’s lukewarm decision affected by the Cojuangco’s friendship with Bantilles with their response to the incident that puts their institution in a bad light for failure to respond appropriately? I wonder how close their relationship is considering Bantilles does not even live in Dasmarinas Village and yet uses a car sticker issued to the Cojuangcos. I can understand the phrase that you can’t choose your relatives but what in the world is wrong here, with a friend like that who needs enemies, LOL.

In contrast Robert “Blair” Carabuena does not seem to be well connected thus he went to the MMDA and did his public apology but insincerely according to some observers. It was easier for people to see the disparity and bullying all because the victim, Traffic Enforcer Saturnino Fabros is a poor widower with school age daughters to feed and support while living in a shanty. Thank goodness for the social media without it said incident would not have been noticed and the bully could still be terrorizing those he deemed weaklings.

So many crimes remain unsolved or perpetrators not prosecuted because they were not caught in the act by concerned citizen taking a video with cell phone and was not in the social media radar. I wonder how the democratizing character of the internet will be affected by the recent Sottomized PNoy Cybercrime Law, will it dampen the enthusiasm of social media netizens to help tilt the balance?

Apathy remains to be one of our biggest stumbling blocks in our trek towards a robust democracy. The timing of the passage of the Sottomized Cybercrime Law as we approach the 2013 national election will definitely contribute to the increase in apathy when people’s rights and freedom of expression are frustrated and repressed by an unjust law where the Philippine version of libel was inserted. Never mind that it was declared by the UNHRC where the Philippines is one of the signatory as a human rights violation, but let us see if this will indeed affect the gun poking incident negatively in favor of the bully.

Lest I get accused of being homophobic let me reiterate that I am not and actually support LGBT issues. It is for this reason that I am clarifying the issue on where I stand and this anonymous comment that does not seem to appear on the blog which I quote:
I am all for anti bullying. But this article repeatedly mentioning that the father might be gay, indicates that the writer is possibly homophobic. How is that detail of any relevance?
It should be noteworthy to point out that people with conflicted sexual orientation unless they deal with it positively will create more problems for the one concerned and even those around him and people that happen to cross his path. I could be wrong but there are cases where their violence prone demeanor and action can be traced to their conflicted sexual orientation, like the case of Muktarai Mai. While this is an extreme example it merits some attention and hopefully enables us to understand what goes on in a bullies mind. Perhaps try to figure out why grown men have no problem kidnapping, torturing, and gang banging a 12 year old boy for walking besides a girl of a higher caste which to them is a “crime” worthy of gangnam errr gang rape.

Now what has all that got to do or what relevance as anonymous pointed out has all that got to do with the Collegio San Agustin incident? It’s something that needs to be explored considering what we know now or what JD the son of Bantilles is telling us now after their complete silence if indeed it was true. 

According to JD’s claims that it was the victim who actually hit them first and denies he fondled the victim’s private part and behind. Further stating he was just defending his boyfriend who was stabbed by the victim with his ball pen. Funny thing is JD’s version of the incident makes it appear that the victim’s “threat” to him and his boyfriend was what angered his father Roy Negro. Enough for him to storm the faculty room where the victim is at, and yes because his jaw was “hurting” he did not see his father pointing a gun at the victim’s forehead, LOL.

Here’s the deal why it is difficult to believe the son of Bantilles account or version of the incident. If he is on a verbal tussle with the victim it will be difficult for the victim to have hit him forcefully in the jaw. Shouting match are done on a distance or so close in your face confrontation. You have to be pushed away first if you are in the in your face verbal confrontation that makes you out of balance to get hit in the jaw. Now unless the victim is like Manny Pacquaio which I really doubt when I saw his demeanor on TV, he can really hit one in the jaw no matter how they are positioned. The most likely position to get hit in the jaw so forcefully as he claims, is that he was probably caught with his hand holding his weenie taunting him while looking up at the victim being taller thus exposing his jaw for the big whammy, LOL.

So what’s the big deal says JD while denying he fondled the victim’s private parts. His classmates he says do the touching on each other, no one gets bothered by it, brushing it off as normal. Say what? Hold your weenies este horse here folks! Are you listening to this or paying attention to the claims of JD Fr. Horacio, boys in your school touch each others ding dongs inside the campus in public at that and it is normal? Well, if that is true and they keep doing it, pretty soon they might do what the grown men of that village in Pakistan do as a form of initiation and kids will brush it off as normal?

Bullying is a problem that has to be dealt with early on while bullies are in their formative years, wait a little longer and you will have raised the likes of Angelino "Boyet" Fajardo or worse a Rolito Go and they became a menace to society which is a sad failure in parenting. Perhaps this will spur you to action, imagine your sweet loving son and daughter because you as a parent and the school fails big time in dealing with his/her bullying problem woke up one day and see in your son or daughter the likes of Boyet Fajardo or Rolito Go. Or worse you become a clone of Jason Ivler's mother, now think about that people.

It appears that bullying has long been Collegio San Agustin's problem and just like the case of Jamie they failed in resolving the issues as shown in this video of a bullying victim's father interviewed by Ces Drillon.
Meanwhile former classmates of the victim’s mother Toni Gonzalez-Garcia batch 83 of Assumption College came out with letter campaign against the bullying incident at Collegio San Agustin, posted here in case you want to pass it around.
