Vicki Belo's Cyberspace Libel Suit Ought to be Heard Nowhere but on Netizen's Facebook Forum

Here we go again, libel, libel everywhere, where it stops no one knows? The Philippines indeed is teeming with onion skinned indiciduals, as if filing a libel suit really clears what they believe was their good name and refutation. As if we don't have enough pending cases due to the snail paced justice dispensation we see frivolous libel suits clogging the system when there are serious pressing cases that deserved to be heard expediently.

Once again we are about to witness a spectacle involving Dr. Vicki Belo of the botched ass job against activist lawyer Argee Guevarra, I am posting this article sent to my FB inbox

Facebook User Welcomes Dr. Vicky Belo's Libel Suit "As First of its Kind" in the World

Facebook user and activist-lawyer Argee Guevarra today welcomed the libel suit filed by the Belo Medical Group and Dr..Vicki Belo against him at the Office of the City Prosecutor in Taytay, Rizal, Philippines, for his status updates and shout-outs in his private Facebook account.

Guevarra, who acts as counsel for Belo victim Josefina Norcio over two botched butt augmentation procedures performed by the Belo Medical Group using the banned substance Hydrogel, was sued for libel over status update posts in his Facebook account where Guevarra called for a national patients’ boycott of Belo Clinics and for referring to Dr. Belo as “Reyna ng Kaplastikan, Reyna ng Kapalpakan” (Queen of False Pretenses, Queen of Incompetence).

Dr.Vicki Belo is a celebrity doctor previously involved in a video sex scandal. She operates upscale plastic and cosmetic surgery clinics frequented by this impoverished nation’s elite and owns various offshore clinics and booking offices in Thailand, South Korea and the United States. Dr. Belo, however, is not licensed by the Philippine Association of Plastic Reconstructive and Aesthetic Surgeons (PAPRAS) to perform cosmetic surgery procedures. She presides over a multi-million dollar empire consisting of plastic surgery clinics, beauty salons and manufactures health and beauty products.

The suit is the first Facebook libel case in the world where the complainant does not even belong to the defendant’s network of Facebook friends. A previous Facebook libel case was, however, filed in UK where businessman Mathew Firsht sued a former school friend over a false personal profile on the site that included private information about him and untrue allegations about his sexual orientation.

The libel suit against Guevarra was commenced vicariously through Dr. Belo’s general manager who managed to add herself to Guevarra’s network of 1,472 friends.

Guevarra, a political activist previously jailed by the Arroyo regime for his participation in two failed uprisings, similarly faced a Php 300 million ($6 million) libel suit from former First Lady Imelda Marcos 13 years ago after Guevarra wrote in his erstwhile column in BusinessWorld, a series of commentaries accusing the former strongman’s wife of widespread plunder during the reign of the Marcos dictatorship. The libel suit was eventually dismissed.

Guevarra welcomes the libel suit as an opportunity to invite public attention to the hazards and dangers of cosmetic surgery clinics performing surgeries with untrained, unskilled, incompetent and unlicensed medical practitioners and advertising such services as safe and hopes to ring alarm bells at the Health Department against the proliferation of such colorum clinics which is destroying the country’s medical tourism industry and earning for the country the moniker of being Asia’s No. 1 Chop Shop. More than this, Guevarra seeks to defend himself all the way to the Supreme Court in order to elicit jurisprudence regarding internet-based libels.

Guevarra reacted to the libel suit in his Facebook status update which states: "A wannabe mortician masquerading as a cosmetic surgeon will never be able to stitch up the difference between formalin or botox, between free speech or slander when suing for libel a Facebook user for his shout outs and status updates. Such surgical stupidity results in mistaking Facebook for Erasebook”.


For his part, Atty.Guevarra’s counsel, Atty. J.V. Bautista, a U.P. classmate of Dr. Belo, laughed off the libel suit and pointed out its material defects – “The libel case filed by Dr. Belo needs a serious facelift before it could even be dignified in any court of law. The pleading itself reads and looks like a failed surgery on the laws of libel …

First, the venue is improperly laid. It should not have been filed before the Taytay Prosecutor Office and instead filed before Makati City Prosecutor’s Office which is the place of the offended party (Dr. Belo) and where Facebook, Philippines holds Office. The filing of the case in Taytay may have sinister motives. What is so special about filing the case in Taytay?

Second, the libelous statements were printed and published by Dr. Belo’s own general manager and upon the authority given her by Dr. Belo’s estranged husband and Belo Medical Group Corporate Secretary Atom Henares, which should make said general manager a co-respondent of Atty. Guevarra. In effect, Dr. Belo should be suing her own general manager;

Third, the alleged defamatory statements are privileged communication and are per se, not libelous. Said statements of Atty.Guevarra fall under constitutionally protected exercise of free speech;

Finally, the analogous libel case of Alfonso Yuchengco/Pacific Plans vs. Philip Piccio, arising from a blog written by Mr. Piccio against Pacific Plans was ordered dismissed by the Department of Justice which ruled that there is no such thing as internet libel since Art. 355 of the Revised Penal Code strictly provides that libel can only be committed by means set forth therein (writing, printing, radio etc.) and does not include the internet. Furthermore, criminal statutes are construed strictly in favor of the accused.”

The preliminary investigation is set on Sept. 24, 2009 at the Taytay Hall of Justice, Taytay, Rizal before Asst. City Prosecutor Cheloy Garrafil.

The Coming 2010 Philippine Election & Boob Circus Creates a Fiesta Mocking Frenzy

The National Boob errrr Bureau of Investigation or NBI is hot on the trail of the leak, no not Gloria Arroyo's plastic boob leak that some smart aleck says they intend to put a plug to stop the national embarrassment but the source of the leak at the Asian Hospital. The place where it all started when Gloria Arroyo went for H1N1 check-up to earn her PR mileage showing even the president is willing to undergo self-quarantine if we go by the initial story telling a lie of presidential hogwash errr mouthpiece Cerge Remonde. What a disaster it was no not the nation but the bootlickers so used to deceiving people had a major debacle akin to Comical Ali's.
Virgilio GarcillanoPatricio Mangubat is asking if leaking the leak on the presidential boob job is in violation of a so-called penal code on national security. Well, that seems odd or better yet to borrow Cerge Remonde's heavy Visayan accent description of the boob job leak as ahbbsoorhd errr absurd because a boob job is a boob job and however you look at it, it's still a boob job nothing more nothing less. It has nothing to do with national security at whatever angle you look at it except in the eyes of bootlickers of the Garcified regime.

The poor fellow whoever he/she is in big trouble and I don’t think the NBI should be running after the culprit just because they are our prestigious National BOOB errr Bureau of Investigation that runs after boob job faulty, fake or otherwise. Medical records are supposed to be confidential and it can only be divulged to a third party if the patient gave his/her consent but this is the president of a country although with questionable mandate still runs the show and therefore we had the right to know. Furthermore knowing her health condition is in no way a national security concern. Had Cerge Remonde and the palace people been more straight forward with the Filipino people this would not have reached into a national mockery.

What's up with the Department of Injustice poking their finger on the boob errr the leak, don't they have other more pressing cases to pursue than search and harass the source of the leak? Hopefully not to suffer the same fate as Bentain, Acza Ramirez, Jun Lozada and many others who could have sent people in the vacation destination that Romeo Jalosjos the convicted pedophile spent some leisure time.. the Bilibid Prisons.

True, there are issues that merit our attention than this presidential mammoplasty augmentation and according my new found Facebook friend Fengshui Aldric, they are making a boob errr a mountain of Gloria Arroyo’s mole errr molehill as if our natural resources has gone scarce…. a political farce that is. Well said my friend and how I agree that whatever legacy this administration will leave us if ever they have any intention to leave ranging from plastic governance to plastic surgery all the way to Lore-LIE Fajardo, yikes, what ever that means or is she?

Lintang BedolWhat is really disturbing in this national embarrassment is a reflection of the poor priority in allocating resources to petty investigation that embarrasses Gloria Arroyo when there are embarrassments that literally make a mockery of the system such as Lintang bedol. The fugitive Lintang Bedol who they seem unwilling to locate (last reported possibly in the US) was sentenced to six months of imprisonment and fined P1,000 after being found guilty of indirect contempt by the COMELEC. While the NBI scrambles to locate the boob leak years have passed where Lintang Bedol could not be found, no formal charges has been filed in the electoral fraud where he is a suspect. If Bedol was the increbedol errr is truly a sign of this administration’s incredulity what about the original math wizard backdoor operator Virgilio Garcillano? Talk about credibility right, not only do cheaters make a mockery of the electoral process, now the woman cheating errr seating by the Pasig River Palace is also one boob errr big mockery courtesy of incorrigible fumbling presidential mouthpiece Remonde and the gang errr palace officials.

So where are the twin nightmares of the national fiesta we call elections in the Philippines? Leslie Bocobo at FaceBook says Garci and Bedol are currently enrolled in a crony computer school taking up 'Automation 101.' To which Ferrum Mann brilliantly posted his response at FaceBook notes below.

BASIC (Bello's Antipolo Sweatshop to Impose Counterfeits),

They might as well use

If they do, it's time the people do a power re-boot!

Where will this election lead us? Will this be a turning point towards political maturity or manurity? I can't help but compare this with Iranian Blogger and President Mahmoud Ahmadinejad who says vote, despite being derided by critics, was the 'freest and the healthiest election the world has ever seen' and that ' the path people are taking is clearer than before.'

Sounds familiar Isn't it? It is all about who can tell a bigger lie and no one can do anything about it. Never mind that people are rioting in the streets of Tehran or people in different neighborhoods climbing up their rooftops during and after his speech chanting "God is great!" and Death to the dictator!" just like Gloria Arroyo who was caught with her leaking breast err pants down ooops yikes I meant exposed in a taped conversation in rigging the last election still deludes herself and deceives the people of a "clear mandate."

Hayden Kho/Katrina Halili sex scandal turns into a Senate circus freak show

What is the difference between an antique collector and antique lover boys?

An antique collector may not necessarily love antiques but they keep their antiques while an antique lover boy is kept by the antique as a trophy…… get it? If not just go ask Lolit Solis, lol.

Leave it to the senate and of course with the help of madaya errr media to turn a sex scandal into a spectacle of sorts that truly belongs to a circus freak show. No wonder the Jester in Exile is exasperated at how the indistinguishable errr distinguished ladies and gentleman are wasting tax peso so they can indulge in their silly sound byte moment in time for the next election. Really, what is the point of a senate investigation in aid of legislation when it was a simple case of video voyeurism and all it takes is to pass a law to that effect? What do we expect anyway from traditional politicians who gets elected based on personality and popularity contest where patronage politics is the name of the game?

Now what’s up with celebrity actor turned foolitician errrr politician Bong Revilla stating that he saw the pirated sex video of Kho and Halili before the later went to his office for assistance? Was it curiosity or the voyeur instinct that prompted him to see the sex video? I say you are busted Senator Revilla, you should know better that mere possession of pirated video is illegal? We settled for jokers so we get bad jokes in return to ruin errrr run the legislative office and it gets worse when celebrities are among their peers making a circus out of a scandal.

Then we have Erap Jr., errrr war freak Senator Jinggoy Estrada snarling at Hayden Kho’s lawyer a woman at that as if he was acting out in an action movie truly unbecoming of one in his stature being a senator.

For one it seems that the savior of imaginary Chip Tsao Filipina maid Senator Pia Cayetano has her feet firmly on the ground this time around unlike in the past, perhaps she had a good dose of reality pill? She was right in pointing out that there is no need for a senate hearing that will do more harm than good to the victim. Apparently this does not bode well with Senator Jamby Madrigal who wants to have her share of perceived “glory” retorting like a juvenile brat that those who see no need for the senate hearing are just envious of the scandal that fell on the committee she chairs. At least now we can say that Joan of Arc Pia Cayetano should stay away from satire and focus on reality for her to come up with realistic response.

Now what is the point of former policeman/politician Abner afuang turned celebrity/bounty hunter in the movies dousing the dud errr stud with water? I know you do that with dogs on heat so I wonder if that was the intention.

It appears according to reports that aside from Katrina Halili there are a total of 40 sex video collection of director errrr doctor to borrow Katrina’s description of Hayden Kho. So if it was true that he had a compilation of 40 sex video of different women what does that make of Hayden Kho? Perhaps a serial peeping Tom or just one out of control oversexed man who can’t get enough of it? The compilation in Hayden Kho’s hard drive also includes refurbished antique errrr Dr. Vicky Belo's intimate tryst who according to the claims of Halili that Kho told her that Dr. Belo was aware of. If indeed the reports are accurate then Dr. Belo was aware of his peeping Tom boy toy’s illegal videotaping of the sexual encounters. Now the question is how come it was only Katrina Halili’s sex video that came out and whoever “stole” the video did not distribute the footage where Dr. Vicky Belo was in it? Is it because it will not sell for obvious reasons as in who wants to watch an oldie but not exactly goodie in bed or is it someting else?

What a circus and spectacle to watch this unfold as the protagonist tries desperately to dig their hole deeper in trouble. Just like a good mama’s boy as if on cue Hayden Kho takes the same stance as the mama Irene Kho that it was Katrina Halili who introduced and dealt ecstasy drugs to him. Duh, the guy is a doctor so in effect he allowed his lover who is not a doctor prescribed for him drugs to improve and enhance his sexual encounter? I wonder why he needs to enhance the tryst, is he confused on his sexual preference like what other observers at Stuart Santiago blog are insinuating?

Is this a case of if I am going down so you are also going down with me? Is it about desperately trying to get the sympathy of the public? Good luck on that one though but one thing for sure is we can only hope that as the plot thickens the authorities should at least address this issue squarely and get the drug dealer who seems to be the culprit in the distribution of the sex video. Will the authorities ran after this cretin of a drug dealer who according to Patricio mangubat of New Philippine Revolution is a powerful and influential figure? Said suspect an alleged member of the Triad Gang used to do "business" with the Alabang boys and is well connected in high places, so will we see the authorities pursue the suspected drug dealer? Or as usual let it be as the criminal is too powerful for them to even dare touch?

Now here is the kicker and since Katrina Halili was an endorser of the clinic where Hayden Kho is a doctor, is Katrina a patient and so are the other women in the sex video compilation? If they are then he is one doctor that Terri Hatcher, the actress playing Susan in Desperate Housewives would really go for a Brazilian wax first according to Manuel Buencamino for fear of a hidden camera. Seriously, if Katrina Halili or any other women in the sex video is a patient then this punk errrr hunk is in deep trouble of getting his medical license revoked.


So how in the name of sound byte grabbing politicians will a senate hearing aid in legislation when Lady Miriam Santiago already authored a bill to address video voyeurism even before the hearing? Is it because they want to satisfy their voyeuristic urge that they just have to go on with a circus of a hearing? If that was not a bad joke unleashed to the people I don't know what is especially with the media turning this spectacle into a shallow partisan contest like the pathetic Philippine election. For one Saksi (witness) a television news broadcast indeed truly lived up to its reputation as an idiot box. Getting some reaction from so-called social sayangtist errrr scientist or "experts" in their field gauging who gets the upper hand on public sympathy between Katrina Halili and Hayden Kho is as dumb as it gets. The issue is clearly about a sexual predator with voyeuristic problem and they make it into a contest of who gets the most PR point is an indication that the Philippine media is not about delivering news per se but editorialized content that caters to parties or individuals they favor. Why they do that is anyone's guess but I dare venture that ATM journalism may have something to do with it.......... or they are simply what they are.... belonging to the idiot box thus the shallow reporting.

Philippine Medical Tourism & the Woes of Louem Martinez

Everything is so cheap where your depreciated dollars go a long way, people catering to your every whims and caprice not a worry in the world. Ideal, isn’t it?

That is exactly what the brochures and internet site entice you, vacationing in the Philippines’ beautiful tropical paradise while at the same time taking a journey towards life-enhancing cosmetic surgery procedures which can restore or enhance your features. A trip so rewarding in terms of gaining inner confidence looking and feeling years younger in your quest for affordable rejuvenation at a significant cost savings that you can only dream of is possible in the tropics.

The growing industry shows a lot of potential that the Philippines have included medical tourism in their government program to get a share of the burgeoning market of neighboring Asian countries.

All is well that ends well in a fairy tall tale, but what happens if somewhere along the line something goes awry and instead of the enhancement you expect from the medical procedure it went south causing undue physical and psychological damage. What will you do? How will you deal with the problem when you are already back home thousands of miles away?

A boon or vain or worse a botched procedure that may not just leave you with a scar or permanent damage to the most delicate part of your body where you dread the most in joining the bandwagon of Philippine Medical Tourism but psychological as well.

That is exactly what happened to Filipino American Louem Martinez also known as Louem Boschuk who underwent a procedure for penile enlargement and ended up in pain and his cherished possession disfigured. Ouch!

At the risk of being the subject of ridicule it took some cajones or should we say his balls are still intact went to a lawyer and filed a P26 million suit against the doctor. Filing a case against the husband and wife popularly known as the “Doctors to the stars” Manuel and Rosario Calayan, registered owners of the Calayan Surgicenter for the botched procedure in 2007. Indeed a mess that Happy Thoughts wished Louem Martinez should have first researched Maxoderm: An alternative for men, than underwent the procedure avoiding the end result of having a "badly deformed, sagged and bumped" prized possession.

Take note, if ever you are contemplating on enhancing your “prized” possession you should check out the Philippine laws and regulation first because they are not exactly the same laws and regulation that you see in the US that protects the patient that holds the medical profession to the highest ethical standards. Also, while there are laws to that effect you have to make sure that the establishment you are dealing with strictly abide and follow said rules and regulations. After all, it is still a nation where corruption is so endemic that some people actually thrived on it and thus skirting the law is a common accepted practice.

It’s a messy legal battle with the Calayans' insisting that the patient signed a liability release form which the patient claimed was shoved to him by the clinics' personnel and no one explained exactly what it means. On the other hand Calayan insist that he explained everything to him and has been doing this procedure for quite some time. Confusing I should say especially when claims and counter claims are opposite what both parties are saying. What is interesting is that the substance used to enhance Martinez pride and glory errr however you want to call it should be enough for one to be ultra cautious if one is contemplating this kind of procedure or any procedure for that matter, to quote:

He and his lawyer Dioscoro Peligro showed reporters a letter from the Bureau of Food and Drugs (BFAD) stating aquagel and aquamid are two different products and chemicals.

I have been told that aquagel is banned, while aquamid needs a permit for its importation and that this has already expired in 2006,” Martinez said.

In the letter, BFAD director Leticia Barbara Gutierrez said both aquagel and aquamid are “medical devices and their registration prior to importation and sale is mandatory.”

“Calayan Surgicenter Corp. is not the licensed importer of the above products,” Gutierrez said.

I know I heard this before that an illegal contract is not enforceable so I just don’t know if this applies in this case. If what the lawyer of Martinez is saying is true then a banned or illegal substance was used to enhance Martinez “pride and glory” that is now deformed so that should really give people the creeps if they are contemplating on similar procedure in the Philippines. Unless one is willing to risk ones deformed "pride and glory" and the hassles of messy lawsuits and counter suits, as shown in this case:

“I did not participate in any of the medical procedures performed on the complainant, nor did I give any opinion or medical advice to the complainant,” she said, adding that Martinez was never her patient.

In her complaint-affidavit filed in April, Rosario Calayan claimed there was no legal basis to hold her liable as she has never met Martinez nor did the patient consult with her.

She also accused the patient of perjury and unjust vexation because of the “malicious filing of the baseless criminal complaint.

Her lawyer Reggie Ukol maintained that such circumstances do not immediately hold her liable for the supposed crime.

“Those circumstance don't mean that there was a conspiracy to commit the crime,” he said in an interview Thursday.

A patient seeking redress for his deformed pride and glory being counter sued is not pleasant and truly makes it a horrible experience. Top that with a banned device if it is true as claimed by Martinez lawyer and BFAD Director Gutierrez implanted inside your body is not exactly safe and reassuring. Calayan claims that it was Aquamid that he used and just made a mistake in saying Aquagel but the point is these substances are irrelevant if both were not approved by BFAD. Think of what will happen if a woman goes for breast augmentation, or reshaping some snub nosed Filipinos that may end up shaped into a bursting tomato using banned medical devices is just scary..... yikes and you get bullied with a counter lawsuit is like adding insult to injury and what about organ transplant? Oh never mind, lets deal with that some other time.......

The problem started when Martinez went to doctor Calayan for the removal of a cyst through Liposuction and the penile enlargement was supposedly an added bonus or part of the package deal. Now what was that all about? Liposuction to remove a cyst? Guess how that turned out? According to the new P14 million complaint of estafa and reckless imprudence resulting in serious physical injury filed by Martinez the operation did not work and the cyst instead spread and grew bigger.

The bottom line is that you get what you paid for and come to think of it the hassles of the court system is not something one enthusiastically wants to get involved with. Dealing with the court system is bad enough and to get entangled in the justice system in the Philippines that is perceived by the public to be corrupt is an experience you don't want to be in. Then the distance which is thousands of miles away does not help either and the time, energy and resources you spend in going back and forth in a court system that is known for its turtle paced disposition is a very expensive proposition. What about the unrealized income that you will lose for the time you have to spend flying back and forth to attend your hearings? Is it worth it?

Luckily or perhaps unluckily whichever way you want to look at it this case was noticed by the press thus hopefully will send a message that people are watching attentively on how this will unfold. But that alone is not a guarantee that the aggrieved party will get justice so what happens if the case is not a celebrated case, what are the chances of getting a decision in favor of the aggrieved party? How many more botched procedures are out there that the victims are not reporting for fear of ridicule and the scandalous embarrassment one has to go through? Playboy hits Philippines with “tasteful” nudity says a praise errr press article at Inquirer but Playboy Philippine Edition is more of an oddity than nudity if we go by the reaction it is getting so far. How “tasteful” well I thought I had stumbled upon one by a Malaysian blogger who I suspect is “jealous” for not having one they can truly call their own. Cakap Tak Serupa Bikin a Malaysian blog had a scoop titled Playboy Philippines nets another beauty showing what he claims was a pic snapped by a paparazzi of an “erotic” lady. I wanted to post the pic here but that would spoil the fun so I suggest you go check it out and see for yourself, but don’t come back and blame me if you are disappointed like the Indonesians according to a Times Online article, to quote:

On sale at 39,000 rupiah (about £2.50), the magazine costs twice the average daily wage in Indonesia, and disappointed buyers called Jakarta’s 68H radio station to say they had expected more.

"It’s a scandal! There’s no nude women in the magazine. I think we have been deceived," said another.

Going back to the Philippine edition it has garnered some interest from some sectors landing in the weird news section of Buck Wolf titled, Just a Nipple: Tame Playboy Enters Philippines:

You won't see bare-breasted women in Playboy's Philippine edition that hits newsstands next week, but the mag does promise "anything under the son of interest to men."

The magazine is treading softly, after the editor of its Playboy Indonesia faced charges of violating indecency laws. Though he was acquitted, rock-throwing protesters in the populous Muslim nation expressed their outrage.

When asked how much skin the mag would show, Spokesman Beting Laygo Dolar told the Associated Press, "Maybe one nipple."

Heck, just one nipple indeed is really weird if not comical and let's hope it's not a one breasted woman as well, lol. Well one consolation for them is that unlike in Indonesia where Playboy Magazine has to contend with magazine burning and physical threat of violence from radical “Jihads” they only have to deal with one Bishop. I am sure with some contributions here and there to the Bishops’ “charity” will rid the magazine of staunch critic…. just ask the daily switikstic (shrewd scammer) errrr sweepstake office on how effective it is. It was so effective that some of the Bishops are going out of their way defending the top beleaguered liar errr executive embroiled in never ending scandal.

Robert Basler finds it odd and humorous in his article "Philippines Playboy, sent in a Manila wrapper?" to quote:

Now, you take Playboy magazine. It’s about to launch a Philippines edition, and who are they aiming at? “Mature men who like well-written articles…” That sounds about right. That cliché was around when I was a kid. We all wanted Playboy for the “articles,” whatever those were.

And there’s more. The editor of the new edition says he doesn’t want to be ashamed to show the magazine to his mom.

Yeah, how many times did I push open the old screen door and say, “Mom! I just got the new Playboy! Here, flip through this and see if you wanna read anything!” Of course she always did, and that evening we’d all have Jell-O by the fire, while Mama read Hef’s “Playboy Philosophy” out loud. Ah, good times.

Of course the oddity will not be complete without a heated debate, which can be found here at Feministing with a very apt description in one word........ ew. Let us see how Grandpa Hugh Heffner’s Magazine fare in the Philippines in a market that is fool errr full of competition. I just don't know about the so-called "tasteful nudity" and at the rate they are going I Think Playboy Philippine Edition is more of an oddity than nudity.
