  4. Emilia T. Boncodin - Secretary of the Department of Budget and Management from 2001 to 2005 and All Officials of the Department of Budget and Management for the Year 2004

  5. All Officials of the Office of the President of the Philippines for the Year 2004, including Gloria Macapagal Arroyo who was the President of the Philippines immediately before and immediately after 30 JUNE 2004

  6. All Representatives and Senators of the 13th CONGRESS whose signatures appear in the Official Vouchers involved

  7. All COMELEC Commissioners for the Year 2004
The prima facie evidence that incontronvertibly proves that the disbursement of the P728 Million Fertilizer Fund was a SCAM perpetrated by the abovementioned individuals as a SYNDICATED PLUNDER of government funds is the 2004 Report of the Commission on Audit (COA) that the FUND WAS TOO BIG, based on the FACT that the fertilizer fund for 2003 was only P28.613 million for the entire Philippines. Based on reasonable provisions for price increase from 2003 to 2004 and increase in the scope of coverage of the Fertilizer Subsidy Program, there is absolutely no way for the corresponding adjustments to justify the amount of P728 Million released for the year 2004. Based solely on this FACT, ALL the individuals involved should be IMMEDIATELY arrested BEFORE anyone of them can repeat the FLIGHT OUT OF THE COUNTRY that was already done by former Undersecretary Jocelyn Bolante.


In addition, the following FACTS are PROOFS that the CRIME of SYNDICATED PLUNDER has been committed:

1) NO PUBLIC BIDDING

It is the policy of the Government of the Republic of the Philippines to procure goods and services generally through public bidding, which shall be transparent. Based on the OFFICIAL 2004 COA report, no public bidding was conducted and the fertilizers were purchased from exclusive distributors. Furthermore, the OFFICIAL 2004 COA report indicated that other brands of fertilizer "with equivalent composition" could have been obtained at lower prices.

2) GROSS OVERPRICING

The OFFICIAL 2004 COA report indicated that the fertilizers supplied were grossly overpriced. The example cited was ordinary foliar fertilizer overpriced by almost 700 to 1,250 percent.

3) WRONG FERTILIZER

The OFFICIAL 2004 COA report indicated that the P728 Million fund was disbursed for the purchase and distribution of foliar fertilizer. This type of fertilizer is appropriate for ornamental plants and not for rice.

4) NON-EXISTENT/"GHOST" AND QUESTIONABLE SUPPLIERS

The OFFICIAL 2004 COA report indicated that the transactions involved non-existent or "ghost" and questionable suppliers. One of the identified suppliers, Akame Marketing, was reported to have a telephone number corresponding to a vegetable stall in Caloocan City. The OFFICIAL 2004 COA report also contained that a witness stated that Feshan Philippines Inc., one of the largest suppliers, was originally a medical supplier and began supplying fertilizer only in 2004.

5) NON-EXISTENT / "GHOST" RECIPIENTS

The OFFICIAL 2004 COA report established that the transactions also involved non-existent or "ghost" recipients. COA auditors were able to trace the actual sites/locations of the DELIVERY ADDRESSES indicated in OFFICIAL documents for only five (5) out of thirteen(13) Non-Government Organizations (NGOs) that supposedly entered into agreements concerning the fertilizer fund, and which signed for the actual deliveries made, based on OFFICIAL documents.

Furthermore, the following FACTS are PROOFS that the CRIME of SYNDICATED PLUNDER was committed DIRECTLY in connection with the PRESIDENTIAL ELECTION scheduled in MAY 2004:

1) NOT PLANTING SEASON

The OFFICIAL 2004 COA report indicated that the P728 Million fertilizer fund was released in the months of February to May 2004, the traditional harvest season in the country and when fertilizers are of no use. As the archives of the official records of National Economic Development Authority, Department of Budget and Management, Department of Agriculture, and the Commission On Audit reflect, planting time in the country starts in the month of November. Incontrovertibly, everyone in the Republic of the Philippines know that the disbursement of the P728 Million was fast tracked during the months of February, March, April, and May 2004 BEFORE the scheduled PRESIDENTIAL election on 10 MAY 2004.

2) FARM-LESS CONGRESSIONAL DISTRICTS

The OFFICIAL 2004 COA report proved incontrovertibly that the CRIME of SYNDICATED PLUNDER was committed IN COLLUSION with REPRESENTATIVES and SENATORS of the 13th CONGRESS because EVEN the congressional FARM-LESS Metro Manila were INCLUDED in the LIST of DESIGNATED beneficiaries/recipients of the P728 Million FERTILIZER FUND. Also, the OFFICIAL 2004 COA report incontrovertibly proved that the Special Alloment Release Order (SARO) specified the disbursement of UNIFORM AMOUNTS, regardless of which congressional districts or local units the proponents were representing, whether the same were rice or corn-producing Local Government Units (LGUs) or not.

3) THE ONE AND ONLY ISOLATED CASE IN THE HISTORY OF AGRICULTURE IN THE PHILIPPINES

The OFFICIAL 2004 COA report incontrovertbily proved the CRIME of SYNDICATED PLUNDER was commited DIRECTLY in connection with the PRESIDENTIAL election on 10 MAY 2004 because it was the ONE AND ONLY isolated case in the history of agriculture in the Philippines when a ONE-TIME, BIG TIME disbursement of the FERTILIZER FUND was done during the HARVEST SEASON that was IMMEDIATELY BEFORE the scheduled PRESIDENTIAL election in MAY 2004. There was NEVER any similar single appropriation done in the history of agriculture in the Philippines BEFORE the Presidential election in MAY 2004. And the huge expense has NOT been repeated AFTER May 2004, as if agriculture has been WIPED OUT of the economy of the Republic of the Philippines!

Accordingly, the COMMISSION ON AUDIT (COA) as the CONSTITUTIONALLY INDEPENDENT BODY empowered by the 1987 PHILIPPINE CONSTITUTION has the DUTY and OBLIGATION, representing the SOVEREIGN WILL of the FILIPINO PEOPLE, to ORDER the ENTIRE Philippine National Police (PNP), and if necessary including the Armed Forces of the Philippines (AFP), based on the existing hierarchy from the TOP to the BOTTOM, in the event of FAILURE of ANY level of superior officers, to effect the IMMEDIATE ARREST of the following:

  1. Jocelyn Bolante - Undersecretary of the Department of Agriculture in 2004

  2. Luis Lorenzo - Secretary of the Department of Agriculture from 2002 to July 2004
    Arthur Cua Yap - Secretary of the Department of Agriculture from August 2004 up to June 2005
